01
Scope
This Privacy Policy applies to information handled through fincaestates.com and communications that result from a website inquiry. It includes information submitted through FINCA’s property-sale inquiry form, leasing inquiries, and general inquiries.
This policy does not govern independent third-party websites, services, listing platforms, brokers, title companies, attorneys, inspectors, or other parties whose websites or services may be linked from the site or involved in a potential transaction. Their privacy practices are governed by their own policies and applicable law.
02
Information We Handle
Information you provide
Depending on the inquiry, FINCA may receive your name, email address, telephone number, property street address, city and ZIP code, property type, occupancy status, preferred reply method, and property details or other information you choose to include.
If you contact FINCA by telephone or email, FINCA may also retain the information contained in that communication and related business records.
Please do not provide Social Security numbers, government identification numbers, passwords, bank or payment-card information, account or loan numbers, mortgage balances, foreclosure documents, tax-delinquency records, medical information, or other sensitive personal or financial information.
Technical information
The systems used to operate, deliver, and protect the website and its forms may process basic technical information, such as network address, browser or device information, request logs, and similar operational data. This information may be used to deliver the site, receive inquiries, maintain security, diagnose problems, and prevent misuse.
03
How We Use Information
FINCA may use information to:
- receive, review, and respond to an inquiry;
- communicate about the property or subject identified by the person making the inquiry;
- schedule an appointment or property walkthrough when appropriate;
- evaluate a possible direct purchase by FINCA for its own account;
- address leasing or general business questions;
- maintain appropriate inquiry, business, and transaction records;
- operate, protect, and improve the reliability and security of the website and communication systems;
- prevent misuse, fraud, or other harmful activity; and
- comply with applicable requirements and establish, exercise, or defend legal rights.
Submitting a property inquiry does not create an agency, brokerage, advisory, fiduciary, or other representative relationship. It does not guarantee an offer and does not obligate the property owner or FINCA to enter a transaction.
04
How Information May Be Disclosed
Information may be handled by service providers that support the website, forms, email, communications, security, recordkeeping, or other business operations, subject to the services and protections applicable to those systems.
When reasonably necessary to evaluate or complete a possible transaction, FINCA may provide relevant information to attorneys, title professionals, inspectors, contractors, accountants, or other transaction participants. FINCA may also disclose information when you direct or authorize it; when reasonably necessary to comply with law, valid legal process, or governmental requests; or when reasonably necessary to protect rights, property, safety, or the integrity of the website.
FINCA does not disclose inquiry information more broadly than reasonably necessary for these purposes.
05
Communications
When you submit an inquiry or contact FINCA, you request a response using the contact information you provide. FINCA may contact you by telephone or email about that inquiry, the identified property, an appointment, or a potential transaction.
Submitting an inquiry does not by itself enroll you in recurring promotional text messages. If FINCA introduces a separate marketing or text-message program in the future, any additional consent process and applicable disclosures will be presented separately.
06
Retention
FINCA keeps inquiry information for as long as reasonably needed to review and respond to the inquiry; evaluate or document a potential or completed transaction; maintain appropriate business records; satisfy legal, accounting, or recordkeeping obligations; resolve disputes; prevent misuse; and protect the website and FINCA’s rights.
Information may then be deleted, securely disposed of, or deidentified when reasonably practicable, subject to legitimate transaction, legal, security, backup, and recordkeeping needs.
07
Security
FINCA uses reasonable administrative, technical, and physical measures designed to protect information under its control from unauthorized access, use, alteration, or disclosure. These measures include limiting access to people and providers with a legitimate business need and maintaining reasonable account, device, and information-handling practices.
No website, email, electronic transmission, or storage system can be guaranteed completely secure. If you believe information submitted to FINCA may have been compromised, contact FINCA promptly using the information below.
08
Your Requests
You may contact FINCA to ask about, correct, or request deletion of information you submitted through the website. FINCA may take reasonable steps to verify the request and may retain information when reasonably necessary for a potential or completed transaction, legal obligation, security matter, dispute, fraud-prevention purpose, or appropriate recordkeeping need.
You may also ask FINCA to stop non-transactional communications. Communications reasonably necessary to respond to an active inquiry, administer a transaction, satisfy legal obligations, or protect rights may continue as appropriate.
09
Children’s Privacy
This website is intended for adults seeking information about FINCA’s business and is not directed to children under 13. FINCA does not knowingly request personal information from children under 13 through its inquiry forms. If FINCA learns that a child under 13 submitted personal information, FINCA may take reasonable steps to delete it.
10
Third-Party Services and Links
The website may link to independent websites or services, including a resident portal, property listing platform, brokerage, or other transaction resource. A link does not mean FINCA controls that third party’s privacy, security, content, or practices. Review the privacy terms provided by the third party before submitting information to it.
11
Changes to This Policy
FINCA may update this Privacy Policy to reflect changes in the website, information practices, business operations, or applicable requirements. The current version will be posted on this page with its effective date. Material changes will apply prospectively unless otherwise stated or required by law.
